I've done some research on the 23rd and don't recall any incidents like the one you mention. As far as courts martial are concerned, I know Colonel Kinsman (Killed at Big Black River) was court martialed for disobeying his brigade commander - I don't recall the exact circumstances right off the top of my head. I believe he was found not guilty. If you want more information, let me know - I may be able to find more details for you.
